1. Delivery Region and Method

ACK Soğutma Sistemleri Sanayi Ticaret Limited Şirketi (the "Seller") delivers ordered products within the borders of the Republic of Turkey, to the address notified by the Buyer at the time of order through the website. Small and standard-volume products are delivered through the courier companies with which the Seller has an agreement. For large-volume cooling equipment that cannot be carried by standard courier due to its size, weight or manner of transport (display-type coolers, cabinet-type coolers, room-type cold storage units and similar products), delivery is carried out through a special freight organization or an affiliated freight/warehousing service coordinated by the Seller. For such products, the Seller may request information regarding access conditions at the delivery address (vehicle access, elevator/stairwell conditions, need for assisting personnel for loading/unloading, etc.) during the ordering process; the Seller is not liable for any delay or additional cost arising from information declared by the Buyer being incomplete or inaccurate.

2. Delivery Periods

Products supplied from stock are handed over to the courier or freight carrier within three (3) to seven (7) business days following confirmation of the order. For products specially manufactured or configured at the Buyer's request, the production and shipping period is stated on the order/payment page at the time of order confirmation, or separately notified to the Buyer. In any event, regardless of the committed period, the product is delivered to the Buyer, or to the third party designated by the Buyer at the indicated address, within the maximum period of thirty (30) days prescribed by the Regulation on Distance Contracts. The periods stated above refer to the period within which the product is handed over to, or shipped by, the courier/freight carrier; the actual transport and distribution times of the courier/freight company depend on that company's own operational processes and are not directly within the Seller's control.

3. Delivery Costs

Delivery/courier and freight costs are borne by the Buyer, unless otherwise expressly stated under a specific campaign run by the Seller. These costs are separately and clearly shown on the order/payment page before the order is confirmed; no hidden or additional delivery cost not disclosed to the Buyer is charged after order confirmation. Where large-volume cooling equipment requires a special freight organization, the freight cost is likewise shown to the Buyer before order confirmation.

4. Inspection Upon Delivery

The Buyer, or the third party designated by the Buyer, is obliged to inspect the outer packaging of the product in the presence of the courier or freight personnel at the time of delivery. Where there is any suspicion that the packaging has been crushed, torn, wetted, or that the product may have been damaged during transport, a report ("tutanak") must be drawn up with the courier/freight company's representative before the product is accepted, and the damaged product must not be accepted. Claims for transport-related damage asserted after a product has been accepted without such a report having been drawn up may not be evaluated. The Buyer should send a copy of the report to the Seller as soon as possible by email at [email protected]; this notification enables damaged-delivery claims to be resolved promptly.

5. Assembly

The scope of delivery covers only the transport of the product to the address notified by the Buyer; assembly, installation or commissioning of the product is not included in the delivery service. For products requiring assembly and/or commissioning, this service is provided, at the Buyer's request, under a separate agreement to be concluded with the Seller or an authorized service provider referred by the Seller, for a separate fee. Products requiring assembly should not be operated before assembly and commissioning have been completed; the Seller is not liable for any malfunction or damage arising in such circumstances.

6. Force Majeure

Where delivery cannot be carried out within the committed or statutory maximum period due to natural disaster, fire, epidemic, decisions of official authorities, import/export restrictions, production or raw-material supply problems attributable to the manufacturer or supplier, extraordinary disruptions in transport and logistics infrastructure, and similar circumstances that arise beyond the Seller's reasonable control and could not have been foreseen ("force majeure"), the Seller shall notify the Buyer within a reasonable period from becoming aware of the circumstance. Where the force majeure event continues and delivery is significantly delayed as a result, the Buyer may, at its option, either continue to await the order or rescind the agreement and request a full refund of the amount paid, including any delivery costs, within fourteen (14) days.
